These Terms of Service (“Terms”) govern your access to and use of the United In Style website, services, and any purchases made through our store (collectively, the “Services”). By accessing, browsing, or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
1) Who We Are
“United In Style,” “we,” “us,” and “our” refer to United In Style, a for-profit business operating with a social-impact donation model (“1 Purchase = 1 Donation”). We are not a 501(c)(3) nonprofit unless explicitly stated otherwise.
2) Eligibility and User Responsibilities
By using the Services, you represent that:
- You are at least 18 years old (or the age of majority in your jurisdiction).
- You have the legal authority to enter into these Terms.
- You will provide accurate, current information when making a purchase or contacting us.
- You will use the Services only in compliance with these Terms and applicable law.
3) Changes to These Terms
We may update these Terms at any time. Changes are effective when posted. Your continued use after updates constitutes acceptance. If you do not agree to the updated Terms, stop using the Services.
4) Privacy
Your use of the Services is also subject to our Privacy Policy. Payment processing is handled through secure third-party processors. We do not sell customer data.
5) Purchases, Pricing, and Payment
5.1 Orders
All orders are subject to acceptance and availability. We reserve the right to:
- Refuse or cancel any order for any reason, including suspected fraud, pricing errors, inventory issues, or policy violations.
- Limit quantities per customer or per order.
- Verify customer information before processing.
5.2 Pricing Errors
If a product is listed at an incorrect price due to error, we may cancel the order and refund any amounts paid.
5.3 Taxes and Fees
Prices may not include applicable taxes or shipping fees, which will be displayed at checkout when applicable.
6) Shipping and Delivery
Shipping times are estimates and not guarantees. Once an order is handed to the carrier, delivery issues (delays, misdeliveries, theft after delivery confirmation) are managed through the carrier’s process. We are not liable for carrier-caused delays or losses after confirmed delivery.
7) Returns, Refunds, and Exchanges
Our Return & Refund Policy governs returns and exchanges. Key terms:
- Returns may be accepted only for eligible items in unworn condition within the stated return window shown on our website.
- Exchanges depend on inventory availability.
- Donation actions triggered by a purchase are not reversible even if a return is approved, because the donation model is activated at purchase and may be fulfilled quickly.
We may refuse returns if we reasonably believe items were worn, altered, damaged after delivery, or returned outside the applicable window.
8) “1 Purchase = 1 Donation” Social Impact Model
8.1 How Donations Work
United In Style operates a donation model where a qualifying purchase triggers donation of clothing or essential items to individuals and families in need. Donations may be fulfilled using new inventory, overstock, liquidation apparel, or items purchased for donation with business funds. Donation frequency and methods may vary based on logistics, community needs, inventory, and partnerships.
8.2 No Guarantee of Specific Recipient or Item
We do not guarantee:
- A specific beneficiary, location, organization, or family (including fire victims or emergency relief recipients).
- A specific brand, size, color, or exact item being donated.
We commit to the mission and impact process, but fulfillment is flexible to match real-world needs.
8.3 Proof of Impact and Privacy
We may post impact updates (counts, stacks, partner acknowledgments). We do not show identifiable faces without written consent.
8.4 Donations Are Not Refunds
Donations are not a “refund” mechanism, cash-value credit, or charitable receipt.
9) Accounts (If Applicable)
If you create an account, you are responsible for maintaining confidentiality of your login and for all activity under your account. We may suspend or terminate accounts for violations or suspected misuse.
10) Prohibited Conduct and Acceptable Use
You agree not to:
- Use the Services for unlawful, fraudulent, or abusive purposes.
- Attempt to disrupt, attack, scrape, reverse engineer, or bypass security of the Services.
- Upload or transmit malware, spam, or harmful code.
- Harass, defame, threaten, impersonate others, or post deceptive content.
- Misuse forms, contact channels, or customer support.
We may restrict access, block IPs, cancel orders, and pursue legal remedies if we believe prohibited conduct occurred.
11) Intellectual Property and Brand Protection
11.1 Ownership
All content, designs, graphics, logos, mascots, slogans, product names, and site materials are owned by United In Style or licensed to us and are protected by intellectual property laws.
11.2 United In Style Name — Strict Protection
United In Style™ is a protected brand identity. No individual or entity may use “United In Style” (or any confusingly similar variation) for any purpose without explicit written authorization. This includes business names, domains, social handles, merchandising, marketing, or promotions.
11.3 Enforcement
Unauthorized use may result in:
- Cease-and-desist demands
- Platform and host takedown notices
- Domain disputes
- Claims for damages and legal fees
- Any other remedies available under law
12) User Content (Reviews, Comments, Submissions)
If you submit content (reviews, images, messages, testimonials), you grant United In Style a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute that content for business purposes (e.g., marketing), unless you explicitly request otherwise in writing and we agree.
You may not submit content that is unlawful, defamatory, hateful, or infringing.
13) DMCA / Copyright Complaints and Brand Disputes
If you believe content on our site infringes your copyright, send a written notice including:
- Your full name and contact info
- The copyrighted work claimed to be infringed
- The URL/location of the allegedly infringing material
- A statement made under penalty of perjury that your claim is accurate and authorized
We reserve the right to remove content and/or terminate repeat infringers.
If someone alleges we infringe their rights, we may respond with a counter-notice and defend our brand vigorously.
14) Disclaimer of Warranties
THE SERVICES AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” TO THE FULLEST EXTENT PERMITTED BY LAW. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Some jurisdictions limit disclaimers. Where prohibited, this section is limited to the maximum permitted by law.
15) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, UNITED IN STYLE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, OR LOSS OF GOODWILL.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES OR PRODUCTS WILL NOT EXCEED THE AMOUNT YOU PAID TO UNITED IN STYLE FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM (OR $100, WHICHEVER IS LESS), UNLESS A HIGHER LIMIT IS REQUIRED BY LAW.
16) Indemnification
You agree to defend, indemnify, and hold harmless United In Style and its owners, employees, contractors, and partners from and against any claims, damages, losses, liabilities, and expenses (including attorneys’ fees) arising out of:
- Your use or misuse of the Services
- Your violation of these Terms
- Your violation of any law or third-party rights
- Your unauthorized use of our brand, name, or IP
17) Disputes, Arbitration, and Class-Action Waiver (Major Protection)
PLEASE READ CAREFULLY—THIS AFFECTS YOUR LEGAL RIGHTS.
17.1 Mandatory Informal Resolution First
Before filing a claim, you agree to contact us and attempt to resolve the dispute informally in good faith.
17.2 Binding Arbitration
Except for claims eligible for small claims court or claims for injunctive relief to protect intellectual property (brand protection), any dispute arising out of or relating to these Terms or the Services will be resolved by binding arbitration, not in court.
Arbitration will be conducted on an individual basis by a recognized arbitration provider, under its rules, in Virginia (or remotely, if allowed). The arbitrator may award the same damages and relief as a court, but only to the extent permitted by these Terms.
17.3 Class Action Waiver
You agree that disputes will be brought only in your individual capacity and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding.
17.4 Injunctive Relief for Brand/IP
We may seek immediate injunctive relief in court to protect our intellectual property, brand name, domain identity, and related rights.
18) Governing Law and Venue
These Terms are governed by the laws of the Commonwealth of Virginia and applicable federal law, without regard to conflict-of-law principles. Where arbitration does not apply, you agree that exclusive venue will be in state or federal courts located in Virginia.
19) Termination
We may suspend or terminate access to the Services at any time for violations, suspected abuse, fraud, or to protect the brand and community. Termination does not waive our rights or your obligations (including payment, indemnification, or dispute resolution).
20) Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.
21) No Waiver
Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
22) Entire Agreement
These Terms, together with our Privacy Policy, Return & Refund Policy, and any posted legal notices, constitute the entire agreement between you and United In Style regarding the Services.
